What the Law Requires of Landlords

The Gas Safety (Installation and Use) Regulations 1998 place clear legal duties on every landlord in the UK. Here's what you're required to do — and what happens if you don't.

Annual Gas Safety Check

All gas appliances and flues must be inspected every 12 months by a Gas Safe registered engineer. This cannot be deferred or skipped — even if the appliances appear to be working correctly.

Provide Certificate to Tenants

A copy of the CP12 certificate must be given to existing tenants within 28 days of each inspection, and to new tenants before they move in. Failure to do so is a criminal offence.

Keep Records for Two Years

All gas safety records must be retained for a minimum of two years. Andy provides digital certificates that can be stored easily and retrieved whenever needed.

Landlords are responsible for ensuring that all gas appliances, fittings and flues in the property are maintained in a safe condition at all times — not just at the point of inspection.

Gas Safety Certificate FAQs

Every 12 months without exception. The law requires landlords to have all gas appliances and flues checked annually by a Gas Safe registered engineer. The renewal date is typically 12 months from the date of the previous inspection. Andy can remind you when your certificate is due for renewal so you never fall out of compliance.
All gas appliances provided by the landlord must be included — typically the boiler, any gas fires, gas cookers or hobs, warm air units and any other gas-burning equipment. Appliances owned by the tenant (not provided by the landlord) do not legally need to be included, but Andy will flag any safety concerns with tenant-owned appliances as a matter of good practice.
If an appliance is found to be unsafe during an inspection, Andy will explain the issue clearly and advise on the necessary remedial works. Depending on the severity, he may be able to carry out the repair on the same visit, or arrange a follow-up. An unsafe appliance must be disconnected or made safe before a CP12 can be issued — Andy will never issue a certificate for an installation that doesn't meet safety standards.
If the property has no gas supply and no gas appliances, there is no legal requirement for a gas safety certificate. However, if there is a gas supply to the property — even if it's not currently connected to any appliances — it is advisable to have the pipework inspected to ensure it is capped off safely. Andy can advise on this during a visit.
Tenants can refuse access, but landlords are required to take all reasonable steps to carry out the inspection. This includes writing to the tenant to explain the legal requirement, offering multiple appointment times, and documenting all attempts made. If a tenant persistently refuses, legal advice should be sought. As a landlord, as long as you can demonstrate you took all reasonable steps, you are unlikely to face prosecution.
Certificates are issued digitally on the same day as the inspection, provided all appliances pass. Andy emails the certificate directly to you immediately after the inspection is complete. If urgent, Andy offers priority same-day or next-day bookings for landlords who need a certificate quickly — for example, ahead of a new tenancy starting.
